Please read these Terms of Service carefully before using Lucky Reg Pro. By accessing or using our service, you agree to be bound by these terms. If you do not agree, do not use the service.
1. Introduction and Parties
These Terms of Service (“Agreement”) govern the relationship between Lucky Reg Pro, LLC, a Texas limited liability company (“Lucky Reg Pro,” “we,” “us,” or “our”) and the business entity or individual (“Client” or “Operator”) that accesses or uses the Lucky Reg Pro software platform and associated services.
By signing up for, accessing, or using Lucky Reg Pro, the Client agrees to be bound by this Agreement. If the Client does not agree to these terms, they must not use the platform.
Important: Lucky Reg Pro is a business-to-business (B2B) software platform. Lucky Reg Pro is a technology supplier and SaaS provider only. Lucky Reg Pro is not a sweepstakes operator, gaming operator, KYC provider, financial institution, or data custodian on behalf of players. All references in this Agreement to “player” data refer to data processed by the platform on behalf of and under the direction of the Operator.
2. Services Provided
Lucky Reg Pro provides the following SaaS services to licensed sweepstakes and gaming Operators:
- Player onboarding automation: The platform reads data from a player’s driver’s license via a connected scanner, parses the data in-application, and populates an onboarding registration form.
- Local data storage: A defined subset of registration data (see Section 5) is stored in an encrypted, local SQLite database on hardware operated at the Client’s premises.
- Third-party API integration: Upon Operator configuration, the platform forwards certain registration fields to the Operator’s configured third-party casino or gaming platform (e.g., Fortune2Go, RiverPay). Lucky Reg Pro facilitates this transmission on behalf of the Operator.
- Membership card printing: The platform supports printing of player membership cards for use at the Operator’s location.
- Welcome email: Upon successful registration, the platform sends a configurable welcome email to the registered player on behalf of the Operator, directing them to the Operator’s website or platform.
- Optional equipment: Lucky Reg Pro offers optional hardware (scanner, printer) for lease or purchase. See Section 6.
Not included in services: Lucky Reg Pro does not operate sweepstakes or gaming activities, does not determine player eligibility, does not perform Know Your Customer (KYC) verification, and does not process or store player payment information.
3. Client Responsibilities and Compliance
The Client is solely responsible for:
- Obtaining and maintaining all required federal, state, and local licenses, permits, and registrations necessary to operate sweepstakes or gaming activities in their jurisdiction(s).
- Ensuring that their use of Lucky Reg Pro and the data processed through it complies with all applicable laws, including but not limited to sweepstakes regulations, gaming laws, data privacy laws, and consumer protection statutes.
- Determining the eligibility of players to participate in their sweepstakes or gaming activities. While Lucky Reg Pro captures date of birth from a player’s driver’s license, Lucky Reg Pro does not perform age verification or eligibility determinations. That responsibility rests solely with the Operator.
- Complying with all state and federal laws governing the collection, storage, and use of driver’s license data and personally identifiable information, including but not limited to Illinois BIPA, Texas CUBI, CCPA, and any applicable state privacy statutes.
- Ensuring that players are appropriately informed about data collection practices at the point of registration, including through any required notices, disclosures, or consents mandated by applicable law.
- Maintaining accurate business, licensing, and tax information with Lucky Reg Pro and ensuring it remains current throughout the term of this Agreement.
- Providing Lucky Reg Pro with accurate configuration information for any third-party integrations (e.g., casino platform API credentials). Lucky Reg Pro is not responsible for errors resulting from Operator-provided configuration data.
4. Payment Terms
- Fees: Clients agree to pay the fees associated with the services selected during signup. Standard pricing is listed below; promotional or discounted rates may be offered at Lucky Reg Pro’s discretion and will be reflected in the Client’s order confirmation at signup:
- Initial Setup Fee: $999 (standard rate) — one-time, due at signup; promotional pricing may apply as noted in the Client’s order confirmation
- Monthly SaaS/Maintenance Fee: $200 — recurring, billed monthly
- Equipment Rental Fee: $100/month — if applicable (rental only; equipment remains property of Lucky Reg Pro)
- Equipment Rent-to-Own Fee: $185/month — if applicable (12-month term; title transfers to Client upon completion of term and receipt of full payment)
- Equipment Purchase Fee: $2,000 — one-time, if applicable (title transfers to Client upon receipt of full payment)
- Payment processor: All payments are processed securely via Stripe, Inc., a third-party payment processor. Lucky Reg Pro does not collect or store Client payment card or bank account data directly. Client’s use of Stripe is subject to Stripe’s own terms of service and privacy policy.
- Clients authorize recurring monthly charges to the payment method provided at signup for the duration of the Agreement.
- All fees are non-refundable except as expressly required by applicable law.
- Cancellation: If a Client cancels their subscription, access to the platform will remain active through the end of the current paid billing period. The application will display a persistent warning to the Client upon login notifying them of the scheduled access end date. No refund will be issued for the remaining portion of the billing period. There is no reactivation fee; Clients may resubscribe at any time through the Lucky Reg Pro subscription page.
- Payment failure: If a recurring payment fails, Lucky Reg Pro will notify the Client and Stripe will automatically retry the charge. The application will display a persistent warning upon login notifying the Client of the failed payment and directing them to update their billing information. If payment is not successfully collected within 7 days of the initial failure, Lucky Reg Pro reserves the right to suspend access to the platform until the outstanding balance is resolved. Suspension of platform access does not suspend or waive any obligations under a concurrent equipment lease or rent-to-own agreement; those obligations continue independently.
5. Data Collection, Storage, and Handling
5a. Driver’s License Data — What We Collect
When a player’s driver’s license is scanned using the Lucky Reg Pro platform, the scanner transmits raw barcode data to the Lucky Reg Pro application. The application parses this data in-process. The following fields are retained in an encrypted, local SQLite database on the Operator’s hardware. In addition, the platform collects the patron’s phone number (required for registration) and email address (optional). These fields, when collected, are also stored in the encrypted local SQLite database. The email address, if provided, is used to send the patron a welcome email on behalf of the Operator upon successful registration:

5b. Fields Parsed But Not Retained
The following fields are parsed from the license scan in memory for on-screen display or validation purposes only. They are not written to any database and are discarded after the session:
- Middle name
- Address, city, state (address), ZIP, country
- Height, eye color, sex/gender (from scan)
- License issue date and expiration date
- Raw barcode string
5c. Third-Party API Data Forwarding
Where the Operator has configured a third-party casino or gaming platform integration (such as Fortune2Go or RiverPay), the Lucky Reg Pro application will transmit a subset of player registration data — which may include name, date of birth, DL state, and DL number — to that platform via HTTP/API call. This transmission is:
- Initiated by the application on behalf of the Operator;
- Subject to the third party’s own terms, privacy policy, and data handling practices;
- The Operator’s responsibility to ensure is lawful under applicable data privacy and gaming regulations.
Lucky Reg Pro is not responsible for the data practices of third-party platforms configured by the Operator.
6. Equipment — Lease and Purchase Terms
6a. Equipment Lease
- Ownership: Leased equipment remains the property of Lucky Reg Pro or its leasing partner at all times.
- Lease term: The equipment rental term is 24 months from the date of Client signup. Monthly rental payments are processed automatically via Stripe on the Client’s subscription billing date, which is determined by the date on which the Client subscribes to Lucky Reg Pro through Stripe and may vary by Client.
- Maintenance and support: Hardware maintenance and repair for leased equipment is provided by the equipment manufacturer. Lucky Reg Pro facilitates procurement but is not a hardware repair or maintenance provider. Clients must contact Lucky Reg Pro to coordinate any manufacturer support requests.
- Client obligations: Clients must (a) use equipment only for its intended purpose; (b) not sell, transfer, or modify equipment without written consent; (c) maintain appropriate insurance covering the equipment against damage, theft, and loss; and (d) notify Lucky Reg Pro immediately of any damage, theft, or malfunction.
- Liability for damage or loss: The Client is responsible for any damage, theft, or loss of leased equipment during the lease term beyond normal wear and tear.
- Early termination: Early termination of a lease may result in fees equal to the remaining balance of the lease term.
- End of lease: At lease end, Client may renew, upgrade, or purchase the equipment at a price to be agreed upon in writing.
6b. Equipment Purchase
- Ownership: Title passes to Client upon receipt of full payment.
- Maintenance: Client is solely responsible for all maintenance, repair, and replacement costs after purchase. Any manufacturer warranty is passed through to the Client; Lucky Reg Pro makes no independent warranty on purchased hardware.
- Payment: Payment for purchased equipment is due in full at the time of purchase unless a financing arrangement is separately agreed in writing.
7. Term and Termination
- This Agreement commences on the date of Client signup and continues on a month-to-month basis unless otherwise agreed in writing.
- Either party may terminate this Agreement at any time. Upon a Client’s voluntary cancellation, access to the platform will remain active through the end of the current paid billing period in accordance with Section 4.
- Lucky Reg Pro may terminate or suspend access immediately upon material breach by the Client, including use of the platform in violation of applicable law. Non-payment is governed by the payment failure process in Section 4; access may be suspended after the 7-day grace period if payment remains outstanding.
- Upon termination or expiration of access, the Client’s ability to use the Lucky Reg Pro platform will be blocked. Any outstanding fees remain due and payable. The encrypted local SQLite database containing patron registration data remains on the Client’s hardware after access termination but is inaccessible — the encryption keys and application required to read the data are not available without an active subscription. The database file is only removed if the Client uninstalls the Lucky Reg Pro application. The Client remains solely responsible for compliance with all applicable laws governing any data retained on their hardware following termination.
- For lease agreements, termination of the SaaS Agreement does not automatically terminate the equipment lease; lease terms govern independently.
- Clients who resubscribe after cancellation or suspension may do so at any time through the Lucky Reg Pro subscription page. No reactivation fee applies. Resubscription restores platform access; the Client’s existing local database and configuration will be accessible upon reactivation provided the application was not uninstalled.
8. Limitation of Liability and Disclaimers
To the fullest extent permitted by applicable law:
- Lucky Reg Pro is not liable for any legal, regulatory, or compliance issues arising from the Client’s operation of sweepstakes or gaming activities.
- Lucky Reg Pro is not liable for errors in data transmitted to third-party platforms resulting from Operator-provided configuration.
- Lucky Reg Pro does not warrant that the platform is error-free or uninterrupted. Platform availability targets, if any, will be set forth in a separate service level agreement.
- Lucky Reg Pro’s total aggregate liability to any Client under this Agreement shall not exceed the total fees paid by that Client to Lucky Reg Pro in the 3 months preceding the claim.
Lucky Reg Pro is not liable for consequential, incidental, special, or punitive damages of any kind.
9. Indemnification
Client agrees to indemnify, defend, and hold harmless Lucky Reg Pro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to:
- Client’s failure to comply with applicable sweepstakes, gaming, or data privacy laws;
- Client’s use of the platform in a manner inconsistent with this Agreement;
- Any claim by a player arising from Client’s operation of sweepstakes or gaming activities;
- Client’s configuration or use of third-party integrations through the platform.
10. Amendments
Lucky Reg Pro reserves the right to modify these Terms of Service at any time. Clients will be notified of material changes via email at least 30 days prior to the effective date. Continued use of the platform after the effective date constitutes acceptance of the modified terms.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Williamson County, Texas, and each party hereby consents to personal jurisdiction and venue in such courts.
